3.2. If shipping costs are charged, these will be clearly stated in good time before the Agreement is concluded. These costs will also be displayed separately during the ordering process and on the invoice or other formal documentation.

This does not affect statutory rights, including mandatory Consumer rights under applicable law (including EU and, where relevant, UK consumer protection law).

4.2. If the Customer has accepted the offer by electronic means, amble & strut will confirm receipt of the Customer’s acceptance by electronic means. Until the Customer receives this confirmation, the Customer may terminate the Agreement.
4.3. If, in accepting or otherwise entering into the Agreement, the Customer has provided incorrect data, amble & strut has the right to postpone performance of the Agreement until the correct data has been received.
Article 5. Registration
5.1. To access and make optimal use of certain features of the Website, Customers may be required to create a personal account by completing the registration form or using the account sign-in option available on the Website.
5.2. During registration, Customers must choose a username and password to access their account on the Website. Customers are responsible for ensuring that their password is sufficiently secure and complies with any security requirements communicated by amble & strut.
5.3. Customers must keep their login credentials, including their username and password, strictly confidential and must not disclose them to third parties. amble & strut shall not be liable for damage resulting from unauthorised use of an account where such use is attributable to the Customer’s failure to comply with this obligation. amble & strut is entitled to assume that any actions carried out via a Customer’s account are performed by the Customer, unless and until the Customer has notified amble & strut of unauthorised access in accordance with clause 5.4. The Customer remains responsible for all activities carried out via their account.
5.4. If a Customer knows or reasonably suspects that their login credentials have been lost, stolen, or otherwise accessed by unauthorised parties, the Customer must change their password without undue delay and notify amble & strut as soon as possible. Upon such notification, amble & strut will take reasonable measures to help secure the account.
5.5. amble & strut may implement reasonable technical and organisational measures to protect the security and integrity of Customer accounts and the Website, including measures to prevent unauthorised access, misuse, or fraud. Customers acknowledge that no online system can be completely secure and agree to cooperate with amble & strut by following any reasonable security instructions provided from time to time.
5.6. amble & strut reserves the right to temporarily suspend or restrict access to a Customer’s account, or to terminate the account, where this is reasonably necessary, including but not limited to the following circumstances:
a) there is a reasonable suspicion of unauthorised access, misuse, or fraudulent activity;
b) the Customer has breached these General Terms and Conditions;
c) the suspension is required to comply with a legal obligation or a request from a competent authority; or
d) the continued use of the account poses a security risk to amble & strut or other users.
5.7. Where reasonably possible, amble & strut will inform the Customer of the suspension or termination and the reasons for it without undue delay. Access will be restored once the issue giving rise to the suspension has been resolved, unless termination is justified.
Article 6. Execution of the Agreement
6.1. Once amble & strut has received and accepted the Customer’s order, it shall process the order and deliver the products to the Customer without undue delay and in accordance with this Article.
6.2. amble & strut is entitled to engage third parties for the performance of its obligations under the Agreement, without prejudice to its responsibility towards the Customer for proper performance of the Agreement.
6.3. Prior to the conclusion of the Agreement, information will be made available regarding the manner in which, and the period within which, the products will be delivered. Unless a specific delivery period has been agreed, delivery shall take place no later than 30 days from the date on which the order is placed.
6.4. If amble & strut is unable to deliver the products within the agreed delivery period, it shall inform the Customer without undue delay. In such case, the Customer is entitled either to agree to a new delivery date or to terminate the Agreement. In the event of termination, any amounts paid by the Customer shall be refunded without undue delay and in any event within 14 days, subject to mandatory law.
6.5. Customers are advised to inspect the products upon receipt and to notify amble & strut of any apparent defects or non-conformity within a reasonable period, preferably by email and, where possible, accompanied by photographs. This does not affect statutory rights, including rights relating to conformity, warranty, and remedies under applicable law.
6.6. The risk of loss of or damage to the products shall pass to the Customer at the moment the products are delivered to the Customer or to a third party designated by the Customer, other than the carrier, in accordance with applicable law.
6.7. If the ordered product is no longer available, amble & strut may offer a substitute product of comparable quality and value, provided that the Customer is informed clearly and in advance. The Customer is not obliged to accept such substitute and is entitled to terminate the Agreement without incurring any costs and to return the substitute product free of charge.
Article 7. Right of withdrawal/return
7.1. This Article applies only if the Customer meets the definition of a Consumer as per Article 1 and is acting outside their trade, business, craft, or profession. Business Customers, or Customers acting in a professional context, have no right of withdrawal under this Article.
7.2. Consumers have the right to withdraw from the Agreement with amble & strut within 30 days after receiving their order, free of charge. amble & strut reserves the right to ask for the reason for return; however, the Consumer is not obliged to provide a reason for exercising the right of withdrawal.
7.3. The withdrawal period commences on the day after the goods have been delivered to the Consumer, or to a third party designated by the Consumer who is not the carrier, or:
A. If the delivery of a product involves different deliveries or parts: the day on which the Consumer, or a third party designated by the Consumer, received the last delivery or the last part;
B. In the case of agreements for the regular delivery of products during a given period: the day on which the Customer, or a third party designated by the Customer, received the last product;
C. If the Customer has ordered several products: the day on which the Customer, or a third party designated by the Consumer, received the last product.
7.4. The Customer bears the direct costs of returning products, with the exception of clause 6.7. Any standard delivery (shipping) costs paid by the Customer and the purchase price paid for the products will be refunded if the entire order is returned, subject to mandatory law.
7.5. During the withdrawal period referred to in paragraph 1, the Customer shall handle the product and its packaging with due care. The Customer may inspect and handle the product only to the extent necessary to establish the nature, characteristics, and functioning of the product, as would be reasonably permitted in a physical retail environment.
7.6. The Customer shall be liable for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the product. This shall not affect the Consumer’s right of withdrawal.
7.7. Consumers may terminate the Agreement in accordance with paragraph 1 of this Article by informing amble & strut of their decision to withdraw from the Agreement within the applicable withdrawal period. Such notification may be made by submitting the model withdrawal form or by making any other unequivocal statement, whether by electronic or other means. Where amble & strut provides the option to submit the withdrawal electronically, amble & strut shall, without undue delay, acknowledge receipt of the withdrawal on a durable medium.
7.8. Consumers shall return the products or hand them over to amble & strut or a person authorised by amble & strut, without undue delay and in any event no later than 14 days from the day on which they informed amble & strut of their decision to withdraw from the Agreement as referred to in paragraph 1.
7.9. Consumers may also exercise their right of withdrawal by returning the products directly to amble & strut within the withdrawal period referred to in paragraph 1, provided that the return is accompanied by a clear written statement of withdrawal, such as the completed model withdrawal form.
Products can be returned to the following address:

7.10. Any amounts already paid by the Customer (in advance) will be refunded as soon as possible, and in any event within 14 days after receipt of the returned goods. amble & strut may postpone the refund until it has received the returned goods (or the Customer has provided evidence of having sent back the goods), in accordance with applicable law.
7.11. Information about the applicability or non-applicability of the right of withdrawal and any required procedure will be posted clearly on the Website well before the Agreement is concluded.
Article 8. Payment
8.1. The Customer shall pay the amounts due to amble & strut in accordance with the ordering procedure and any payment methods indicated on the Website. amble & strut may offer payment methods of its choice and may change these methods from time to time. In cases of payment after delivery, the Customer will be granted a payment term of 14 days starting on the day after delivery has taken place, subject to mandatory law.
Article 9. Warranty and conformity
9.1. This Article applies only if the Customer meets the definition of a Consumer and is a natural person not acting in a professional or commercial capacity. If amble & strut provides a separate commercial warranty on the products, that commercial warranty applies to all Customers, without prejudice to statutory rights.
9.2. amble & strut guarantees that the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and usability, and the applicable statutory provisions and government regulations in force at the time the Agreement is concluded.
9.3. If a delivered product is not in conformity with the Agreement, the Consumer must inform amble & strut within a reasonable period of time after discovering the defect.
9.4. If amble & strut deems the complaint to be valid, the defective product(s) will be repaired, replaced, or refunded in consultation with the Consumer. Any limitation of compensation shall be subject to mandatory law and the Article on liability.
Article 10. Complaints handling procedure
10.1. If the Customer has any grievances in connection with a product (in accordance with the Article on warranty and conformity) and/or other aspects of amble & strut’s service, the Customer may submit a complaint by telephone, email, or post. See the contact details at the bottom of these General Terms and Conditions.
10.2. amble & strut will respond to the complaint as soon as possible, and in any case within 5 days after receiving it. If it is not yet possible for amble & strut to provide a substantive response by that time, amble & strut will confirm receipt of the complaint within 5 days and indicate the period within which it expects to provide a substantive or definitive response to the Customer’s complaint.
10.3. If the Customer is a Consumer, they may file a complaint through the European Online Dispute Resolution platform (for EU/EEA Consumers), available at: http://ec.europa.eu/odr/. For Consumers in the United Kingdom, statutory dispute options remain available under applicable UK law, and amble & strut will provide information upon request.
Article 11. Personal details
11.1. amble & strut will process the Customer’s personal data in accordance with its privacy statement and applicable data protection law (including the GDPR for the EU/EEA and the UK GDPR for the United Kingdom, where applicable).
Article 12. Final provisions
12.1. These General Terms and Conditions and the Agreement are governed by the laws of the Netherlands. For Consumers habitually resident in Germany or the United Kingdom, this choice of law shall not deprive the Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
12.2. Insofar as not dictated otherwise by mandatory law, any disputes arising from the Agreement shall be submitted to the competent court in the Netherlands in the district where amble & strut has its registered office. This does not affect a Consumer’s right to bring proceedings in the courts of their country of habitual residence where mandatory law so provides (including, where applicable, Germany and the United Kingdom).
12.3. If any provision set out in these General Terms and Conditions is held to be void or unenforceable, this shall not affect the validity of the remaining provisions. In that case, the parties will adopt one or more replacement provisions which reflect the original provision as closely as possible under applicable law.
12.4. The term “written” in these General Terms and Conditions also refers to communication by email (and, where applicable, other electronic means), provided that the sender’s identity and the integrity of the communication have been sufficiently established.
